BWC Must Repay 270,000 Employers It Illegally Overcharged
CLEVELAND, OH — In a scathing, unanimous 105 page decision released today, Ohio’s Eighth Appellate District Court (Cuyahoga County) upheld the decision of Judge Richard McMonagle in late 2012 that found the Ohio Bureau of Workers’ Compensation had illegally overcharged 270,000 Ohio employers for premiums hundreds of millions of dollars (San Allen, Inc., et al. vs Stephen Buehrer, Administrator, Ohio Bureau of Workers’ Compensation). The Appellate Court determined that the Bureau engaged in an illegal and improper “cabal” of bureaucrats and lobbyists “who rigged workers’ compensation insurance premium rates” for over fifteen years. The hundreds of thousands of non-group businesses suffered unlawful overcharges and thousands were driven out of business.
